Fast Facts Customer Survey Gift Card Promotion


 

  1. Information on how to enter and the prizes form part of these terms and conditions of entry. By submitting an entry, all participants are deemed to have accepted these terms and conditions.
  2. The competition commences on Monday, 22 November 2010 and concludes at 5pm (AEDT) on Friday, 3 December 2010.
  3. Entry is open to Australian residents aged 18 years and over residing in NSW/ACT/VIC/SA/TAS/WA/NT who are existing customers of the Promoter.
  4. Employees of the Promoter and any agency associated with the competition, and their immediate families, are ineligible to enter the competition. Immediate family includes the spouse, parents, children and siblings of an employee (whether or not they live in the same house).
  5. To enter, participants must complete the Fast Facts Customer Survey distributed by the Promoter by email and submit their preferred contact details.
  6. Participants may enter the competition once only. Only the first valid entry received will be accepted.
  7. Incomplete or indecipherable entries will be disregarded.
  8. No responsibility will be accepted for any late or misdirected entries.
  9. The Promoter’s decision in relation to any aspect of the competition is final and binding on all participants and no correspondence will be entered into.
  10. All ancillary costs associated with entering the competition are the participant’s responsibility, including any costs associated with accessing the Promoter’s website.
  11. There are ten (10) prizes to be won in NSW/ACT/VIC/SA/TAS/WA/NT. The prize is a $50 Coles Group & Myer Gift Card.
  12. The prizes are redeemable at: Myer, Target, Baby Target, Target Country, Kmart, Kmart Tyre & Auto (all outlets from 1 December 2007), Coles supermarkets, Coles Central, BI-LO, Pick’n’Pay Hypermarkets, Liquorland, Vintage Cellars, 1st Choice Liquor Superstore and Officeworks. Redemption of the prizes are subject to the terms of use specified by the issuer, which can be viewed at http://www.giftcards.com.au/termsofuse/ or obtained by contacting the Gift Card Customer Response team on 1300 304 990.
  13. The first ten (10) valid entries selected at random from the drawn will each win a prize.
  14. The total prize pool for this competition is $500. No responsibility is accepted for changes in the prize value occurring after commencement of the competition.
  15. The prizes are not transferable or exchangeable and cannot be redeemed for cash.
  16. The prizes must be taken as stated and no compensation will be payable if a winner is unable to use the prize.
  17. All ancillary costs associated with use of the prizes are the winner’s responsibility, including all taxes and all costs associated with redemption of the prize.
  18. The draw will take place at 2pm (AEDT) on Tuesday, 14 December 2010 at the Promoter’s head office, The Tower, Melbourne Central, Floor 19, 360 Elizabeth Street, Melbourne VIC 3000. The Promoter reserves the right to draw additional entries and record them in the order drawn in case an invalid entry or ineligible participant is drawn.
  19. Winners will be notified by telephone and in writing.
  20. The Promoter reserves the right, at any time during or after the competition, to verify the validity of any entry and to disqualify any participant (including all entries submitted by that participant) who the Promoter has reason to believe has breached these terms and conditions, tampered with the entry process or engaged in any unlawful or improper conduct that may impact the fair and proper conduct of the competition.
  21. The Promoter reserves the right to require proof of the participant’s identity, age and place of residence at the nominated delivery address for the prizes or before.
  22. If for any reason a winner does not take delivery of any prize by the time stipulated by the Promoter the prize will be forfeited, subject to any directions from the relevant gaming authorities.
  23. If any prize is unavailable, the Promoter reserves the right to substitute the prize with a prize of equal value and specification, subject to any directions from the relevant gaming authorities.
  24. Each participant consents to the Promoter using the participant's name, likeness, image and voice in the event they are a winner (including photograph, film and recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the competition (including any outcome) and promoting any products manufactured, distributed or supplied by the Promoter.
  25. The use of any automated entry software or any other mechanical or electronic means that allows a participant to automatically enter repeatedly is prohibited and will render all entries submitted by that participant invalid.
  26. To the extent permitted by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or any damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or in connection with the competition, including (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); or (b) any theft, unauthorised access or third party interference; or (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) any variation in prize value to that stated in these terms and conditions; or (e) any tax implications from entering the competition or winning a prize; or (f) any use of the prize.
  27. As a condition of accepting the prize, each winner must sign any legal documentation as and in the form required by the Promoter, including any legal release and indemnity form.
  28. A failure or delay by the Promoter to exercise any power or right under these terms and conditions does not operate as a waiver of that power or right. The Promoter may exercise any power or right under these terms and conditions in its sole discretion.
  29. All entries become the property of the Promoter. The information about each participant collected by the Promoter is collected for the purpose of conducting the competition. Unless otherwise advised, the Promoter may also use this information for promotional, marketing, publicity, research and profiling purposes (including sending electronic messages or telephoning the participant). The information about each participant collected by the Promoter may be disclosed to third parties (including the participant’s employer, the Promoter’s agents, contractors, related companies and external service providers and the prize supplier) for these purposes. If a participant chooses not to provide some or all of the information requested their entry may be invalid. Participants have a right to access personal information that the Promoter holds about them, subject to any exceptions in relevant legislation.   30. In these terms and conditions ‘including’ and similar expressions are not words of limitation and a reference to ‘prize’ includes any prize and any part of any prize.
  31. The Promoter reserves the right to amend these terms and conditions at any time without prior notice.
